The KSCV immigration law team has an emphasis on business immigration law and assists businesses and individuals navigate the ever changing rules of the U.S. immigration system.  Immigration consists of two different paths; nonimmigrant matters and immigrant matters.  Foreign nationals can apply for various visas such as F-1, J-1 and H-1B to temporarily travel, live and/or work in the United States.  The temporary nature of these visas puts them under the nonimmigrant category of immigration.  The immigrant path is different in that its end goal is citizenship in the United States.  A typical immigration path includes the Labor Certification Application, which tests the labor market, the Immigrant Petition and the Adjustment of Status processes.  KSCV’s immigration team is dedicated to efficient and thorough processing of all immigrant and nonimmigrant matters and has helped businesses and educational entities obtain the talented global workers needed to stay competitive.

When should someone use Advance Parole travel documents? 
Foreign nationals present in the U.S. that have filed I-485 Adjustment of Status applications can utilize Advance Parole. Advance Parole allows the foreign national to return to the U.S. from abroad; (i) without a valid Nonimmigrant Visa; and (ii) without abandoning a recently filed or pending Adjustment of Status Application.  Foreign nationals can renew Advance Parole in one year increments.  An Adjustment of Status Application is not suspended while a foreign national travels abroad, nor does the CIS adjudication of an adjustment case stop. Use of the Advance Parole will not interfere with the filed Adjustment of Status.

What happens to my immigration status after my employment ends? 
The end of employment means the end of a foreign national’s nonimmigrant or immigrant status.  The one exception would be a foreign national with a I-485 Adjustment of Status that has been pending more than 180 months.
